Chemical Facilities Anti-Terrorism Standards – September 2007

The U.S. Department of Homeland Security (DHS) has released an interim final rule that imposes comprehensive federal security regulations for high-risk chemical facilities. This rule establishes risk-based performance standards for the security of our nation’s chemical facilities. The interim final rule requires covered chemical facilities to:

The interim final rule also allows certain covered chemical facilities, in specified circumstances, to submit Alternate Security Programs in lieu of a Security Vulnerability Assessment, Site Security Plan, or both. This regulation becomes effective 60 days after its publication in the Federal Register except for Appendix A.

Development of the Interim Final Rule

Section 550 of the DHS Appropriations Act of 2007 gives the Secretary of the DHS the authority to issue interim final regulations without prior notice and comment, however, the DHS chose to release an Advance Notice of Rulemaking (ANRM) on December 21, 2006; this notice sought comments on the proposed text for the interim final rule as well as on various implementation and policy issues related to the chemical security program. 

How Appendix A: Chemicals of Interest Was Developed

The DHS developed a Chemicals of Interest List (see Appendix A) that includes chemicals that present one or more security issues. In developing the list, the DHS looked to existing expert sources of information including other federal regulations related to chemicals. Among the other sources that the DHS referenced in part are the following:

The DHS will use the Top Screen process to identify the chemicals associated with these security issues as well as to determine their potential future inclusion in Appendix A and/or coverage under Chemical Facility Anti-Terrorism Standards.
